Since the referral of a controversy to judgment of the referees involves one derogation to jurisdiction ordinary, in case doubt in order to interpretation of the scope of the clause compromise, it must be preferable an interp retazione restrittiva di essa e affermativa della giurisdizione statuale, riconoscendosi non rientrare la domanda in contestazione nell'ambito della materia rimessa agli arbitri [per incuriam rispetto all'art. 808-quater cod. proc. civ.]
