Legal Principle

The special procedure for the assessment of arbitrators' costs and fees provided for by Article 814 of the Code of Civil Procedure does not apply to contractual arbitration (arbitrato irrituale), as the latter lacks the capacity to become a judgment upon deposit of the award and the remuneration owed to contractual arbitrators constitutes a debt arising from the mandate, the enforcement of which may be pursued by means of ordinary proceedings.
