Legal Principle

An application under art. 810 of the Code of Civil Procedure presupposes that the arbitration clause has left the appointment of the arbitrator to the parties and that the parties have failed to act. Where the parties have already expressly designated and chosen the arbitrator in the arbitration clause, a judicial appointment under art. 810 of the Code of Civil Procedure may not be made.
