Arbitration case law

sentenza

Court of Bologna, 8 December 2025, No. 3409

Tribunale of Bologna

Legal principle

A contractual clause which confers upon the judicial authority of a specific forum jurisdiction over "all disputes" arising from the contract, excluding arbitral jurisdiction, does not constitute an exclusive jurisdiction clause, but merely identifies the objective scope of application of the derogation from arbitral jurisdiction, leaving operative the ordinary criteria of territorial jurisdiction among the different judicial offices.
