Legal Principle
Third-party opposition to an arbitral award, pursuant to Article 404 of the Code of Civil Procedure, is admissible exclusively where the opponent has an original interest in the arbitral dispute, in that they ought to have been a necessary party to the proceedings, and not where the effects of the award cause merely indirect or consequential prejudice, in respect of which the interested party may assert their rights incidentally in subsequent proceedings.
