Art. 818 of the Italian Civil Code civ. Provides expressly the prohibition for referees of grant kidnappings and other precautionary measures; art. 669-quinquies cod. Proc.
Controversy is object of clause compromise, the question precautionary si proposes to the judge (e not to the referee) which would be state competent a know of the merit.
