A procedure for the authoritative determination of consideration before an independent administrative authority does not oblige the parties to submit to a form of compulsory arbitration and does not infringe the right to a defence, the provision of mechanisms designed to reduce litigation, even compulsory ones, not being contrary to the Charter of Fundamental Rights or to the Constitution, provided that they do not excessively restrict access to judicial protection.
