Legal Principle

An arbitration clause included in a contract has effect limited to the parties who specifically agreed to it and cannot be invoked against third parties to the contract itself, even if they are involved in the overall economic transaction or in the same proceedings.
An arbitration clause contained in a planning agreement excludes the jurisdiction of the ordinary court to adjudicate claims relating to the interpretation and performance of the agreement itself, solely as between the parties who entered into it, whereas the jurisdiction of the ordinary court remains for claims brought by or against persons who are not parties to the agreement.
