Legal Principle
An arbitral award produces, pursuant to art. 824-bis cod. proc. civ., the same effects as a judgment delivered by the judicial authority, so that res judicata formed in arbitral proceedings on a claim brought against a person in a given capacity precludes the re-filing of the same claim on the same legal basis before the ordinary courts, without prejudice to the possibility of differently characterising the claim in relation to a different legal capacity of the defendant.
