Legal Principle

Pursuant to arts. 824-bis and 825 of the Code of Civil Procedure, jurisdiction to grant the declaration of enforceability of an arbitral award vests in the court within whose district the seat of the arbitration is located; the dismissal, by the court of appeal, of the grounds for setting aside the award at the rescinding stage does not preclude the filing of an application for exequatur before the court having jurisdiction by reference to the seat.
