Where the parties conclude an agreement derogating from jurisdiction which confers the power to decide disputes arising out of their relationship on an arbitral tribunal or on a foreign court, the validity of that stipulation cannot be assessed on the basis of the rules in force in the Italian legal order, review under art. 1341 cod. civ. being in particular excluded.
