Legal Principle

An application to set aside an arbitral award under art. 828 of the code of civil procedure is inadmissible where the award has been expressly characterised as an award rendered in contractual arbitration (arbitrato irrituale) by the arbitrator who issued it, since the remedy of setting aside for nullity is reserved to awards rendered in arbitration proper.
