Supreme Court, 14 May 2025, N. 12951
Cassazione
- I Civ.
Legal Principle
A Supreme Court appeal challenging whether an arbitration clause in a framework contract applies to individual implementing contracts must set out specific criticisms that can be immediately and clearly linked to one of the grounds for challenge in Article 360 of the Code of Civil Procedure. It is not enough to challenge generally whether the arbitration clause applies. The criticisms must clearly identify the alleged defects among those that fall within the strict legal categories, or the ground will be inadmissible.
