The Court of Appeal, in proceedings for the challenge of the arbitral award, commits an error in procedendo within the meaning of art. 112 cod. proc. civ. where, rather than examining the grounds actually raised by the cross-appellant, it misconstrues the content of the challenge and declares it inadmissible on the basis of complaints not in fact advanced, when the party had duly and timeously raised the violation of rules of law relating to the merits of the dispute pursuant to art. 829 co. 3 cod. proc. civ., with specific identification of the legal canons of contractual interpretation allegedly infringed.
