Legal Principle

Art. 819-ter co. 3 cod. proc. civ. provides that, in the relationship between arbitration and ordinary proceedings, art. 295 cod. proc. civ. does not apply; it follows that the ordinary court cannot order the mandatory stay of proceedings on the ground that a case pending before arbitrators is preliminary thereto.
