The special forum provided for by art. 637 co. 3 cod. proc. civ. — which enables a barrister to apply for a payment order to the court having jurisdiction by value at the place where the bar council on whose roll he is enrolled has its seat — applies also in respect of fees for advocacy carried out in the context of arbitration proceedings, having regard to the jurisdictional nature of the institution of arbitration and the consequent assimilation of the arbitral decision to a judicial pronouncement, in accordance with the jurisprudential development inaugurated by the judgment of the Corte cost. 376/2001 and confirmed by the Joint Divisions in judgment 8776/2021.
