In matters of public procurement, the shortened time limit for the challenge of the arbitral award provided for by art. 241, co. 15-bis, of d.lgs. n. 163/2006, introduced by art. 5 of d.lgs. n. 53/2010, does not apply to arbitral awards rendered by arbitral tribunals already constituted at the date of entry into force of d.lgs. n. 53/2010; for such awards, the time limit for challenge provided for by art. 828 cod. proc. civ. remains applicable, in accordance with the transitional provisions set out in art. 4, co. 7, of d.l. n. 40/2010, converted with amendments by legge n. 73/2010.
