An arbitration clause providing for the reference of a dispute to a foreign arbitrator is void when the case concerns non-waivable rights, which include the rights of a commercial agent to termination compensation under Article 1751 of the Civil Code, since the relevant regulatory framework is non-derogable to the agent’s detriment pursuant to Article 4, paragraph 2, of Law No. 218 of 31 May 1995.
