In case of clause compromise non -existent the subsequent behavior of the parts not to a remedy the vice of deficiency of power of the referees. such amnesty, foreseen by the AR t. 829, co. 1, n. 4 Cod. proc. civ. in report to art. 817 cod. proc. civ. si applies instead in case of exceeding, from part of the referees, of the limits them taxes compromise.
