An arbitration clause contained in a specific contract does not extend the derogation from the jurisdiction of the ordinary courts and the reference to arbitrators to disputes relating to other contracts, even where such contracts are connected to the principal contract to which the aforementioned clause applies.
The contractual connection between multiple contracts, whilst implying that events affecting one contract have repercussions on the other, does not entail the extension of the effects of the arbitration clause to connected contracts lacking a direct expression of the parties’ intention to that effect.
The arbitration clause applies to disputes concerning the interpretation or performance of the contract containing it, as well as to modifications made by the parties to the original contractual content of the same contract.
