Supreme Court, 22 July 2025, No. 20685

Arbitrators are not required to pursue the special procedure provided for under Article 814, paragraph 2, of the Code of Civil Procedure for the assessment of their fees, and may instead bring ordinary proceedings on the merits. The special procedure presupposes that assessment is sought by all arbitrators who rendered the award, conferring upon the president of the court only the power to determine the quantum of the overall compensation due to all arbitrators. Each arbitrator, or only some of the arbitrators, may proceed according to the general rule in the form of ordinary proceedings on the merits for the determination of the subjective right to compensation.
