For refusing recognition or enforcement of a foreign award under Article 840, paragraph 5, No. 2 of the Code of Civil Procedure, contrariety to public policy means a clear and serious violation of one of the fundamental principles of the domestic legal system. The relevant check must look only at the operative part of the award, without re-examining the merits of the arbitral decision or reviewing its legal correctness.
