The presence of an arbitration clause conferring jurisdiction on arbitrators to decide the dispute on the merits creates incompatibility with preliminary technical investigation proceedings aimed at conciliation under article 696-bis of the Code of Civil Procedure, given that such unilateral procedural instrument conflicts with the parties’ choice to entrust arbitrators with the taking of evidence and any conciliation of the dispute, except where all parties agree to pursue the judicial procedure.
