Court of Vicenza, 9 February 2026, No. 211

For the purposes of recognising the validity of an arbitration clause capable of founding arbitral jurisdiction and excluding the jurisdiction of the ordinary courts, the arbitration agreement must result from an express and unequivocal agreement between the parties; a generic or equivocal reference to general conditions contained on web pages is not sufficient in the absence of specific signature of the arbitration clause itself.
