Legal Principle
An arbitration clause contained in a validly concluded contract entails the lack of jurisdiction of the state court in respect of disputes relating to the performance of that contract, conferring jurisdiction to decide on the arbitrator or arbitrators as agreed by the parties pursuant to Article 806 of the Code of Civil Procedure.
Clauses derogating from jurisdiction, including arbitration clauses, contained in a framework distribution agreement extend also to contracts of sale subsequently entered into between the same parties during the term of the framework agreement, even if such contracts do not expressly reproduce the derogating clauses, where they constitute implementation of the framework agreement and are connected therewith.
