The interpretation of arbitration clauses must be conducted according to extensive criteria in order to avoid the fragmentation of disputes arising from the same contractual relationship. An arbitration clause that refers to arbitrators disputes concerning “the interpretation, performance and termination of the contract” encompasses both the contractor’s obligations to perform and the corresponding payment obligations of the principal. An objection of lack of jurisdiction in favour of arbitration, if timely raised, results in a declaration that the claim brought before the ordinary court is inadmissible pursuant to Article 808-*ter* of the Code of Civil Procedure.
