Arbitration case law

sentenza

Court of Vicenza, 13 January 2026, No. 33

Tribunale of Vicenza

Legal principle

In the field of arbitration, the objection of nullity of the authority to act (mandate) conferred on the same counsel by multiple parties on the ground of an alleged conflict of interest must be dismissed where the interests of the mandating parties, having regard to the particular relationship between them as arising from the contractual arrangement that gave rise to the arbitral dispute, are not in conflict, in which case the powers of attorney conferred must be regarded as fully valid and effective.
