Legal principle

A dispute concerning a debt arising out of the contract which contains the clause conferring arbitral jurisdiction may be referred to arbitrators.
The appointment of a special representative (curatore speciale) pursuant to art. 78 cod. proc. civ. is admissible, including for the purpose of commencing arbitral proceedings, only where it is directed to bringing a claim against a body which has no legal representative, whereas the appointment of a judicial liquidator for that purpose is not permitted.
