In proceedings for the appointment of the sole arbitrator under Article 810 of the Code of Civil Procedure, the procedural inactivity of the applicant party, manifested in the failure to comply with the obligation to supplement the documentation within the time limit set by the court, constitutes a tacit withdrawal of the application where there is an absolute incompatibility between such conduct and the intention to continue the proceedings, resulting in the extinction of the proceedings for lack of continued interest.
