Legal Principle

Under art. 810(4) cod. proc. civ., the president of the court appoints the arbitrator by decree, without the need to summon the parties, where it appears that the arbitration agreement is not manifestly non-existent and does not manifestly provide for a foreign arbitration, and that the dispute does not concern rights which cannot be the subject of arbitration or matters in which the law requires the mandatory intervention of the public prosecutor.
