Legal Principle

An arbitral award rendered in favour of one of the joint and several debtors may be relied upon against the creditor pursuant to Article 1306 of the Civil Code, unless the award is founded on grounds personal to the individual co-debtor, in which case the arbitral award is incapable of producing legal effects in respect of the other joint and several co-obligors.
