The setting aside on appeal to the Court of Cassation of a judgment which had declared a previous arbitral decision void does not bring about the revival of the award, which cannot retain validity and falls away where the remitted proceedings are not conducted, without it being material to distinguish between the case in which the judgment set aside had substitutive effects and that in which it ruled only on the rescission of the earlier decision.
