Where an arbitration clause refers all disputes between the parties to arbitration, the ordinary court that has issued an order for payment must decline jurisdiction pursuant to Article 819 ter(1) of the Code of Civil Procedure, set aside the order for payment and refer the dispute to arbitration, fixing the time limit for the recommencement of proceedings before the arbitrators in accordance with the arrangements agreed by the parties.
