Legal Principle

The ordinary court has jurisdiction to appoint the arbitrator where this is expressly provided for by the arbitration clause contained in the articles of association.
Where an arbitration clause confers upon the arbitrator the power to decide without procedural formalities, the principle of freedom of form applies, subject to the residual application of the provisions of Legislative Decree No. 6 of 17 January 2003 in respect of matters not otherwise agreed by the parties.
