An arbitration clause that refers to arbitrators disputes concerning the interpretation, performance and termination of the contract, in the absence of express contrary intention, confers arbitral jurisdiction only over disputes relating to claims whose cause of action is founded on the contract itself, excluding those seeking compensation for damages arising from pre-contractual liability, which do not have the contract as the constitutive basis of the claim but only as a factual premise.
