Legal principle
A conflict of interests relevant for the purposes of arts. 78 et seq. cod. proc. civ. exists where the person acting as claimant in the arbitral proceedings is at the same time the sole director and legal representative of the respondent company; in such a case a special curator must be appointed to represent the company in relation to the arbitral proceedings.
