An arbitration clause does not preclude recourse to summary proceedings for an order for payment before the ordinary courts, as the arbitrator may not issue such an order; however, in opposition proceedings, where the plea of lack of jurisdiction is jointly acknowledged, the court declares its lack of jurisdiction and revokes the order for payment.
