The presence of an arbitration clause in the contracts submitted to the court establishes arbitral jurisdiction and requires the revocation of the payment order issued by the ordinary court, which lacks jurisdictioto rule on the dispute; the declaration of lack of jurisdiction must be made by judgment, since such a decision entails the nullity and consequent revocation of the opposed payment order.
In opposition proceedings against a payment order, the costs of the proceedings are to be borne by the opposing creditor who brought an action before the judicial authority in the presence of contracts containing an arbitration clause, thereby compelling the debtor to bring opposition proceedings to assert arbitral jurisdiction.
