Legal Principle
An arbitration clause contained in general contract conditions satisfies the requirement of specific written approval under Article 1341 of the Civil Code even when it is referenced by numerical indication within a general reference to all contractual clauses, provided that such reference is accompanied by an indication, albeit summary, of the content of the clause itself.
An arbitration clause that provides for the submission to arbitrators of disputes relating to the interpretation or performance of the contract, including payments, determines the lack of jurisdiction of the ordinary court even when the dispute concerns exclusively payment claims arising from contractual performance.
