An arbitration clause contained in a contract not signed by the party invoking it is ineffective due to the absence of the specific written approval required by Article 1341, paragraph 2, of the Civil Code. The mere production in proceedings of the document containing the clause cannot remedy the requirement of double signature necessary for the effectiveness of particularly onerous conditions.
