Legal Principle

An arbitral award confirmed by a judgment having the force of res judicata, with constitutive effect as to the right of ownership in performance of a preliminary contract of sale, constitutes a valid title enforceable against third parties for the purpose of an action for recovery of possession (rivendica), taking effect from the date of its registration and with retroactive effect to the date of deposit of the award itself.
