An arbitration clause providing for institutional arbitration, by conferring upon the arbitrator a mandate to exercise a function of a jurisdictional nature, gives rise to a lack of jurisdiction of the ordinary court, and the acceptance of the plea of arbitration agreement (eccezione di compromesso) results in a declaration that the court seized lacks jurisdiction in favour of the arbitral tribunal.
