In order-for-payment proceedings brought against a consumer the court must examine of its own motion whether the terms relevant to the subject matter of the claim are unfair, including arbitration clauses derogating from the jurisdiction of the courts, and must record the outcome of that scrutiny in the reasons for the decree.
