An arbitration clause inserted in a procurement contract which provides for arbitral competence over disputes of any nature extends, pursuant to Article 808quater of the Code of Civil Procedure, to disputes relating to the work of the professionals engaged for design, works supervision and accounting, where their activity was instrumental to the performance of the contract, given the contractual link between the professional services and the procurement.
A preliminary technical assessment for conciliation purposes under Article 696bis of the Code of Civil Procedure, having a conciliatory and not a precautionary purpose, may be referred to arbitrators under an arbitration clause, unlike a preliminary technical assessment under Article 696 of the Code of Civil Procedure, which is precautionary in nature.
