In proceedings challenging a contractual arbitration award (lodo irrituale), the court’s jurisdiction is determined in accordance with the provisions of Book I of the Code of Civil Procedure, pursuant to Article 808-ter of the Code of Civil Procedure.
In proceedings challenging a contractual arbitration award (lodo irrituale), errors of fact are reviewable but errors of judgment are not.
Interim relief may be granted as ancillary to an action for the challenge of a contractual arbitration award (lodo irrituale) where the contestation of the right gives rise to effects that are concretely and inevitably prejudicial and must be avoided.
