Legal Principle

The appointment of the arbitral tribunal by the president of the court pursuant to art. 810 of the Code of Civil Procedure constitutes an administrative measure aimed at giving effect to the arbitration agreement, through designation of the arbitrators according to the procedures provided by law in case of inaction by the parties or ineffectiveness of the contractually established mechanisms.
