A clause providing for arbitration with a seat abroad, entered into between an Italian party and a foreign company in a contract concerning disposable rights, is valid and gives rise to a lack of jurisdiction of the Italian court, even where the relationship has connecting factors with Italian territory, provided that the conditions for the application of the protective provisions on consumer contracts under Regulation (EU) No 1215/2012 are not met.
