Where a dispute is referred to arbitration, its value for the purpose of assessing the arbitrators' fees is determined pursuant to art. 10 of Ministerial Decree No. 55/2014, on the basis of the petitum and in accordance with the rules of the Code of Civil Procedure on jurisdiction ratione valoris, irrespective of the decision rendered by the arbitrators, even if limited to a ruling of inadmissibility or non-prosecution of the claim.
The arbitrators' fees, determined pursuant to art. 10 of Ministerial Decree No. 55/2014, are subject to the thirty-per-cent reduction provided for in art. 3, paragraph 1, of Ministerial Decree No. 61/2016.
