Court of Rome, 11 December 2025, No. 17390

The failure by one of the joint venture participants to pay their share of the deposit required for the operation of the arbitral tribunal, resulting in a declaration of termination of the arbitration proceedings due to impossibility of continuation, does not in itself constitute an act capable of interrupting the limitation period for the substantive rights subsequently asserted in judicial proceedings, it remaining the burden of the interested party to plead and prove the existence of specific acts interrupting limitation.
