The existence of an arbitration clause for institutional arbitration does not preclude the jurisdiction of the ordinary court to issue a payment order; however, where an opposition is filed based on the existence of such clause, the court hearing the opposition must declare its lack of jurisdiction in favour of the arbitral tribunal and, consequently, declare the nullity and revoke the payment order challenged.
